The former personal attorney for Donald Trump has resigned as New Jersey's top federal prosecutor. This decision was prompted by a judicial decision that invalidated her eligibility to serve.
Attorney General's Statement
The nation's top law enforcement official, the Attorney General, confirmed her stepping down on Monday. In a statement that the judicial decision made it "untenable" for Habba to perform her duties.
"But do not mistake compliance for surrender," she wrote. "The effort will now reach across the country."
Court Ruling
Habba's exit comes a week after a US appeals court ruled that she had been serving in violation of the law as the top prosecutor. This judgment is expected to impact scores of prosecutions in the state.
The appellate judges said that a interim role that did not receive confirmation by the US Senate ran afoul of the Federal Vacancies Reform Act.
Future Role and Reaction
The Attorney General added that the former prosecutor will continue working within the DOJ as a high-level advisor. She will seek further review of the ruling, in the hope of achieving a different outcome.
Writing online, Bondi argued that judges "must not override the appointment of attorneys tasked with carrying out the fundamental role of the presidency of enforcing the law."
Performance in Office
The attorney general praised her tenure and pointed out that while she was in charge, the city of Newark saw a one-fifth decrease in criminal activity. She also stated that the city of Camden had its first summer in half a century with no murders.
Background and Previous Role
Habba, 41, first joined the former president's legal defense in recent years. Subsequently, she acted for her client in his business records case in New York last year, when he was conviction on multiple felony counts of financial record manipulation.
Earlier, assuming the top New Jersey post, Donald Trump had stated he was selecting her as his senior adviser during his second administration, calling Habba as a steadfast ally and a dedicated fighter for justice.
