Federal Judge Orders Release of Kilmar Abrego Garcia from ICE Custody

Courtroom scene

A court has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his continued detainment lacks legal authority.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her order.

The situation stems from a mistaken removal to El Salvador earlier this year, which the government later admitted was an mistake. Following his repatriation to the United States to face alien smuggling charges, he was held in immigration custody.

In her decision, the court noted that the authorities lacks a current removal order, which prevents them from removing Mr. Abrego Garcia "at this time."

Context of the Case

The court challenge center on disputed assertions. While the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently denies this claim.

He has also entered a not guilty plea to the conspiracy counts, which are part of a ongoing criminal case in the state of Tennessee.

Conditions of Freedom

The judge, who was overseeing his petition to deportation in a Maryland district court, determined that he must now adhere to the terms of his bond from jail in Tennessee. This order effectively transfers his supervision to the Tennessee court.

This ruling represents a significant development in a complicated immigration case involving claims of wrongful detention and disputed gang associations.
